MAP Disclaimer
Overview
Minimum Advertised Price (MAP) rules, marketplace permissions, and advertising/brand guidelines are set and enforced directly by each manufacturer — not by DAS. DAS facilitates onboarding only.
1. Purpose
This policy clarifies who is responsible for MAP and related pricing/marketing rules once a dealer is onboarded to a brand through DAS.
2. MAP is set by the manufacturer
Each manufacturer sets its own MAP policy, marketplace restrictions (such as where a dealer may or may not list products), and advertising or brand guidelines. These vary by manufacturer and are provided to the dealer as part of onboarding information, directly by DAS or directly by the manufacturer.
3. DAS does not set or enforce MAP
DAS is not responsible for setting, monitoring, or enforcing MAP or any other pricing or marketing restriction. DAS does not police dealer pricing, does not conduct MAP compliance sweeps, and does not adjudicate MAP disputes between a dealer and a manufacturer.
4. The dealer's responsibility
It is the dealer's responsibility to review, understand, and comply with the MAP policy and marketing guidelines of each manufacturer they are onboarded to sell. Non-compliance is a matter between the dealer and that manufacturer.
5. Consequences of MAP violations are the manufacturer's to decide
If a manufacturer determines a dealer has violated its MAP policy, any resulting consequence — including price correction demands, suspension, or termination of the dealer's authorization — is determined and administered by the manufacturer. DAS is not liable for, and does not reverse or mediate, a manufacturer's MAP enforcement decisions. A manufacturer's termination of a dealer for a MAP violation does not, by itself, entitle the dealer to a refund of any DAS fee, per the Refund Policy.
6. Changes to MAP
Manufacturers may change their MAP policy at any time, at their own discretion. DAS will pass along updated MAP information when a manufacturer provides it, but does not guarantee advance notice of changes and is not responsible for a dealer's non-compliance with an updated policy the dealer wasn't yet informed of.
